Terms of Service

1. Who we are and what these terms cover

CueGain is operated as a sole trader (toiminimi) registered in Finland, Business ID 3632334-6 ("CueGain", "we"). These terms govern your use of the CueGain web app and the CueGain DJ mobile app. By using CueGain you agree to these terms and to our Privacy Policy.

2. Eligibility

CueGain is designed for live nightlife events and is intended for users aged 18 or over. By using the service you confirm you are at least 18 and legally able to enter into these terms.

3. The service

CueGain lets fans tip DJs, pay for song requests, and book VIP booth access at live, in-person events, and lets DJs receive those payments. Tips are voluntary appreciation. A song request is a paid request that the DJ may accept or decline at their discretion. VIP booth access is subject to the DJ's (and the venue's) confirmation. These are real-world interactions between fans and DJs; CueGain provides the platform that facilitates them and is not a party to the performance itself.

4. DJ accounts

DJs sign in with a passwordless email link. You are responsible for keeping access to your email account secure, for the accuracy of your profile and pricing, and for everything done through your account. One account per person.

5. Payments and fees

Payments are processed by Stripe. CueGain collects payments on the DJ's behalf and charges a 10% platform fee on each transaction; the fan additionally covers the payment processing fee, which is shown before checkout. DJs set their own prices. All amounts are charged in the currency shown at checkout.

6. Refunds

• Song requests: if the DJ declines your request, or it expires without a decision, you are refunded automatically in full.
• VIP booth access: if your booking is not approved, you are refunded automatically in full.
• Tips: tips are voluntary and final once completed, except where a refund is required by law.

Because tips, song requests, and booth access are performed immediately at a live event, by paying you request immediate performance and acknowledge that the EU 14-day right of withdrawal lapses once the service has been fully performed. Your statutory consumer rights are not affected. For anything else, contact support@cuegain.com and we will handle it case by case.

7. DJ payouts and taxes

DJ earnings accumulate in your CueGain balance and can be withdrawn to your connected Stripe account, which requires completing Stripe's onboarding and identity checks. Amounts refunded to fans, reversed, or subject to a chargeback are deducted from your balance. DJs are independent from CueGain and are solely responsible for reporting and paying any taxes on their earnings and for complying with their venue's rules and applicable law.

8. Acceptable use and content

Song request messages and profile content must not be unlawful, threatening, harassing, hateful, obscene, or infringing. We have zero tolerance for objectionable content and abusive behavior: DJs can report abusive fan messages in the app, and we may remove content, refuse transactions, and suspend or terminate access for anyone who violates these rules, commits fraud, or abuses chargebacks. You may not interfere with the service, probe its security, or use it to send spam.

9. Your content and our platform

You keep ownership of the content you submit (profile details, avatars, messages, event banners) and grant CueGain a non-exclusive, worldwide license to host and display it as needed to operate the service. CueGain and its software, design, and branding remain our property.

10. Termination

You may stop using CueGain at any time, and DJs may delete their account in Settings → Danger Zone (see Account & data deletion). We may suspend or terminate access for breach of these terms, fraud, or legal requirement. Earned, unwithdrawn DJ balances remain payable after termination unless they are the proceeds of fraud.

11. Disclaimer and liability

The service is provided "as is" and "as available." To the extent permitted by law, CueGain is not liable for indirect or consequential damages, for the conduct of DJs, fans, or venues, or for events outside our reasonable control, and our total liability to you is limited to the platform fees we earned from your transactions in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited under applicable law, or your mandatory rights as a consumer.

12. Mobile app stores

If you use the CueGain DJ app from the Apple App Store or Google Play: your agreement is with CueGain, not with Apple Inc. or Google LLC; Apple and Google have no obligation to provide maintenance or support for the app and are not responsible for addressing any claims relating to it; you must also comply with the applicable store's terms of service; and Apple and its subsidiaries are third-party beneficiaries of these terms with the right to enforce them against you.

13. Governing law and disputes

These terms are governed by the laws of Finland. If you are a consumer in the EU, you also keep the protection of the mandatory consumer laws of your country of residence, and you may bring disputes before your local courts. Finnish consumers may also refer disputes to the Consumer Disputes Board (kuluttajariita.fi). Please contact us first — most issues are resolved quickly at support@cuegain.com.

14. Changes

We may update these terms as the service evolves. We will post changes here and update the date above; for material changes affecting DJs, we will also notify you by email. Continuing to use CueGain after a change means you accept the updated terms.
